Terms of Service 

Upon becoming a Project Creator or Backer through the registration process or checking out as a guest, you are accepting the Terms and Conditions of Service.

By using the TECHFunder service you agree to the following:

> You will comply with all local, state/provincial, regional & national laws in your area of residence.

> You are to alert the TECHFunder staff of any unauthorized use of your Project Creator or Backer accounts.

> You agree to abide by all our terms and conditions and the Stripe acceptable use policy:

You may not use our service for activities that:

> Relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, matrix programs, other “get rich quick” schemes or certain multi-level marketing programs, (c) are associated with purchases of real property, annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) are for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f) are associated with the following Money Service Business Activities: the sale of traveler’s cheques or money orders, currency exchanges or cheque cashing, or (g) provide certain credit repair or debt settlement services

> Involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent

> Violates applicable laws or industry regulations regarding the sale of (a) tobacco products, or (b) prescription drugs and devices

> Involves gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not it is legally defined as a lottery) and sweepstakes unless the operator has obtained prior approval from Stripe and the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.

Here’s what we don’t allow on theTECHFunder platform:

> Sexually explicit material

> Adult services or products

> Pornography of any kind

> Content associated with hate groups or terrorist organizations

> Underage consumption or abuse of alcohol, tobacco, or narcotics

> Drug abuse, products or paraphernalia

> Offering equity or return-on-investment

> Pyramid or ponzi schemes, “get rich quick” schemes

> Purchases of annuities, investments, equity or lottery contracts

> Offshore banking or currency exchanges

> Betting, gambling, raffles, or sweepstakes

> Offering monetary rewards, including gift cards

> Non-medical or violent bodily mutilation

> Non-prescribed drug use or purchase

> Hurtful or hateful language

> Violent or hateful material

> Supporting or inciting treasonous behavior

> False, misleading, dishonest statements

> Funding or planning an assassination, suicide, or assisted suicide

> The purchase, transfer, or exchange of weapons of any kind including guns, knives, explosives and ammunition

> Campaigns in support of rebel groups, militias, gangs, or any organized violence .

Communications

Electronic communications from TECHFunder will be sent to Project Creators to inform them of a variety of events about the state of their fund. You agree to allow TECHFunder to send these communications to your email address. You also agree that TECHFunder is not liable for any user generated content that is sent to you as a part of these communications.

You can unsubscribe for email notifications at any time.

Modification of Terms of Use

TECHFunder reserves the right, at its sole discretion, to modify or replace any of the Terms of Service, or change, suspend, or discontinue the Service (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the Site or by sending you an email.

TECHFunder may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability. It is your responsibility to check the Terms of Use periodically for changes. Your continued use of the Service following the posting of any changes to the Terms of Service constitutes acceptance of those changes.

Rules and Conduct

As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Service. The Service (including, without limitation, any Content or User Submissions (both as defined below)) is provided only for your own personal, non-commercial use (except as allowed by the terms set forth in the Projects: Fund-Raising and Commerce section of the Terms of Service). You are responsible for all of your activity in connection with the Service. For purposes of the Terms of Service, the term “Content” includes, without limitation, any User Submissions, videos, audio clips, written forum comments, information, data, text, photographs, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible by TECHFunder or its partners on or through the Service.

By way of example, and not as a limitation, you shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any content on or through the Service, including without limitation any User Submission, that:

> Infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty;

> You know is false, misleading, untruthful or inaccurate;

> Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane;

> Constitutes unsolicited or unauthorized advertising or promotional material or any junk mail, spam or chain letters;

> Contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of TECHFunder or any third party; or

> Impersonates any person or entity, including any employee or representative of TECHFunder.

Additionally, you shall not: (i) take any action that imposes or may impose (as determined by TECHFunder in its sole discretion) an unreasonable or disproportionately large load on TECHFunder’s (or its third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Service or any activities conducted on the Service; (iii) bypass any measures TECHFunder may use to prevent or restrict access to the Service (or other accounts, computer systems or networks connected to the Service); (iv) run Maillist, Listserv, any form of auto-responder or “spam” on the Service; or (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Site.

You shall not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Service, except to the limited extent applicable laws specifically prohibit such restriction, (ii) modify, translate, or otherwise create derivative works of any part of the Service, or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws and regulations.

TECHFunder does not guarantee that any Content or User Submissions (as defined below) will be made available on the Site or through the Service. TECHFunder has no obligation to monitor the Site, Service, Content, or User Submissions. However, TECHFunder reserves the right to (i) remove, edit or modify any Content in its sole discretion, including without limitation any User Submissions, from the Site or Service at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if TECHFunder is concerned that you may have violated the Terms of Use), or for no reason at all and (ii) to remove or block any User Submissions from the Service.

You are independently responsible for complying with all applicable laws in all of your actions related to your use of TECHFunder’s services, regardless of the purpose of the use.

Registration

You may browse the Site and view Content without registering, but as a condition to using certain aspects of the Service, you may be required to register with TECHFunder, select a password and provide your name. You shall provide TECHFunder with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your TECHFunder account. You shall not (i) select or use as a name or domain a name of another person with the intent to impersonate that person; (ii) use a name or domain a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as name or domain a name that is otherwise offensive, vulgar or obscene. TECHFunder reserves the right to refuse registration of, or cancel a account in its sole discretion. You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your TECHFunder password. You shall never use another user’s account without such other user’s express permission. You will immediately notify TECHFunder in writing of any unauthorized use of your account, or other account related security breach of which you are aware.
